By accessing, browsing, booking, listing a property, or using Bora Stays in any way, you agree to be bound by these Terms, our Privacy Policy, and any additional policies referenced herein.

Bora Stays is a hospitality and furnished accommodation platform focused on the following service areas.

• Executive and furnished stays
• Vacation and short-term rentals
• Corporate accommodation

• We facilitate connections between guests, property owners, hosts, operators, and service providers across Kenya and other supported markets.

2. Eligibility

To use Bora Stays, you must meet the following conditions.

• Be at least 18 years old
• Have legal authority to enter into binding agreements
• Provide accurate and complete information
• Use the platform in compliance with applicable laws
• You may not use Bora Stays for fraudulent, unlawful, or abusive activities.

3. User Accounts

4. Booking & Reservation Terms

Bookings, reservations, and stay requests are subject to operational and commercial confirmation.

4.1 Reservation Requests

• Partner channels
• Customer support channels
• Reservations are subject to availability, verification, payment confirmation, and host/property approval where applicable.
• A booking is not confirmed until you receive written or electronic confirmation from Bora Stays.

4.2 Pricing

Displayed prices may include the following components.

• Accommodation charges
• Cleaning fees
• Service fees
• Taxes and levies
• Security deposits
• Optional add-ons
• Prices may vary based on seasonality, occupancy, promotions, demand fluctuations, and corporate or negotiated rates.
• We reserve the right to correct pricing errors or cancel bookings affected by system or pricing inaccuracies.

4.3 Payments

Payments may be processed through the following approved methods.

• M-Pesa
• Debit or credit cards
• Bank transfer
• Payment gateways
• Approved third-party processors
• By making a booking, you authorize Bora Stays to charge applicable amounts related to reservations, extensions, damages, penalties, and additional services.
• Failure to complete payment may result in cancellation.

5. Security Deposits

Some properties may require refundable security deposits.

Security deposits may be used to cover the following issues.

• Property damage
• Missing items
• Excessive cleaning
• Smoking violations
• Unauthorized parties
• Policy breaches
• Refund timelines may vary depending on property inspection and payment provider processing.

6. Check-In & Check-Out

Unless otherwise stated, standard check-in is 2:00 PM and standard check-out is 10:00 AM or 11:00 AM.

Early check-in or late check-out is subject to availability and may attract additional charges.

Guests may be required to provide government-issued identification, booking confirmation, and security verification information.

7. Guest Responsibilities

Guests agree to follow the standards below throughout their stay.

• Respect the property and neighbors
• Comply with house rules
• Follow local laws and safety guidelines
• Maintain cleanliness
• Avoid disruptive behavior
• Guests must not host unauthorized parties or events, exceed occupancy limits, engage in illegal activities, damage property, misuse utilities or equipment, or disturb neighboring residents.
• Guests are financially responsible for damages caused during their stay.

8. Property Rules

Specific properties may have additional rules regarding the following areas.

• Smoking
• Noise levels
• Visitors
• Pets
• Parking
• Pool or facility access
• Security procedures
• Property-specific rules form part of these Terms.
• Failure to comply may result in immediate termination of stay, loss of deposit, additional penalties, or removal from the premises.

9. Cancellations & Refunds

Cancellation policies may vary by property, package, season, or promotion.

9.1 Guest Cancellations

Unless otherwise specified, the following cancellation windows generally apply.

• Refunds may exclude payment processing fees, currency conversion charges, and non-refundable service fees.

9.2 Bora Stays or Host Cancellations

We reserve the right to cancel bookings due to property unavailability, safety concerns, fraud detection, force majeure events, regulatory restrictions, or host non-compliance.

Where possible, we may offer alternative accommodation, issue credits, or process refunds.

10. Experiences, Activities & Third-Party Services

Bora Stays may facilitate tours, safaris, transport, concierge services, event experiences, and lifestyle services. These services may be delivered by third-party providers.

• We are not responsible for third-party delays, accidents, injuries, service interruptions, provider misconduct, or external operational failures.
• Participation in experiences is at your own risk.

11. Corporate & Long-Stay Reservations

Corporate bookings may be subject to separate agreements, credit approval, invoicing terms, occupancy policies, and procurement requirements.

Extended stays may require utility management terms, scheduled maintenance access, additional verification, and periodic inspections.

12. Host & Property Partner Terms

Hosts and property partners agree to the following obligations.

• Provide accurate property information
• Maintain legal authority to list properties
• Ensure safety and habitability
• Comply with tourism and tax regulations
• Maintain appropriate licenses and permits where required
• Hosts are responsible for property maintenance, utilities, insurance, tax obligations, and compliance with applicable laws.
• Kenyan short-term rental operations may be subject to licensing and tax obligations under tourism and tax regulations.

13. Prohibited Activities

• Use Bora Stays for unlawful purposes
• Engage in fraud or identity misrepresentation
• Circumvent booking or payment systems
• Harvest user data
• Upload malicious software
• Interfere with platform operations
• Infringe intellectual property rights
• Create false reviews or listings

14. Intellectual Property

All content on Bora Stays including branding, logos, text, designs, graphics, media, and platform technology is owned by Bora Stays or its licensors and protected under applicable intellectual property laws.

You may not reproduce or commercially use Bora Stays content without written permission.

15. Reviews & User Content

Users may submit reviews, ratings, photos, feedback, and testimonials.

By submitting content, you grant Bora Stays a non-exclusive, royalty-free license to use, display, and publish such content for operational and marketing purposes.

• We reserve the right to remove content that is false, offensive, defamatory, misleading, fraudulent, or in violation of applicable laws.

16. Privacy & Data Protection

We process personal information in accordance with applicable privacy and data protection laws, including the Kenya Data Protection Act, 2019 where applicable.

By using Bora Stays, you consent to the collection and processing of information necessary for reservations, customer support, identity verification, payment processing, service improvements, and security and fraud prevention.

17. Platform Availability

We strive to maintain uninterrupted access to Bora Stays but do not guarantee continuous availability, error-free functionality, uninterrupted service, or compatibility with all devices.

We may suspend or modify services for maintenance, security, upgrades, or other operational reasons.

18. Limitation of Liability

To the maximum extent permitted by law, Bora Stays shall not be liable for indirect damages, loss of profits, travel disruptions, personal injury, property loss, third-party actions, force majeure events, or internet or payment failures.

Our total liability arising from a booking or service shall not exceed the amount paid by the user for the affected booking or service.

19. Indemnification

You agree to indemnify and hold harmless Bora Stays, its affiliates, directors, employees, agents, and partners against claims arising from your misuse of the platform, violation of these Terms, damage caused during stays, or legal and regulatory breaches.

20. Force Majeure

We shall not be liable for delays, interruptions, or inability to perform obligations due to events beyond our reasonable control including natural disasters, epidemics or pandemics, government actions, civil unrest, power outages, internet disruptions, transport interruptions, or security threats.

21. Suspension & Termination

We reserve the right to suspend or terminate access to Bora Stays where users violate these Terms, engage in fraud, create security risks, harm other users or hosts, or damage platform integrity.

Termination does not waive outstanding obligations or liabilities.

22. Governing Law

These Terms shall be governed by the laws of the Republic of Kenya.

Any disputes arising from these Terms shall be resolved through good-faith negotiations, mediation where applicable, and courts of competent jurisdiction in Kenya.

23. Amendments to These Terms

We may update these Terms periodically. Updated versions become effective upon publication on our platform. Continued use of Bora Stays after updates constitutes acceptance of revised Terms.
